Terms of Service

Welcome to MaOchlim (What Are We Eating) (MaOchlim Technologies Ltd., Co. No. 517328597) ("Company", "we", "our", or "us"). These Terms of Service ("Terms") govern your use of the MaOchlim mobile app and related services ("App" or "Services"). By using the app or registering for the services, you represent that you have read, understood, and agreed to be bound by these Terms and our Privacy Policy.
1. Eligibility
You must be at least 18 years old to use the app independently. Minors aged 13–17 may use the app only with the explicit written consent (including electronic) of a parent or legal guardian, provided the parent/guardian assumes full responsibility for the minor's use. We reserve the right to require age verification and/or parental consent, and to suspend or close accounts of minors who have not met these requirements. If you are under 13, you may not use the app or create an account.
2. Your Account
- You are solely responsible for maintaining the security of your account and password.
- You must provide accurate information when creating your account.
- You may not use another person's account without permission.
- You can delete your account at any time using the "Delete Account" button on the Settings page.
3. User Content
All content you create or upload to the app (visits, reviews, ratings, photos, messages, etc.) constitutes "User Content" and you remain its sole owner. By posting content to the app, you grant us a non-exclusive, worldwide, royalty-free, transferable and sublicensable license to use, display, distribute, reproduce, store, edit (including for the purpose of operating services, including resizing, cropping, and watermarking) and promote your content for the purpose of operating, promoting, and marketing the app and services. The license expires within 30 days of the deletion of your account or removal of the content by you, except for content already incorporated into other users' content or marketing materials published during the period the license was in effect. You represent that you own all rights to the content you publish and/or in your account, or that you have all necessary permissions to grant this license, and that the content does not infringe any third-party rights.
You agree not to post, upload, or share content that:
- Is illegal, encourages criminal activity, is harmful (including malware), deceptive, threatening, defamatory, obscene, racist, discriminatory based on gender/religion/origin/sexual orientation, or constitutes harassment or invasion of privacy.
- Infringes the intellectual property rights of others.
- Contains spam, malware, or misleading content.
- Includes sexual content or promotes violence.
- Impersonates another person or entity.
4. Acceptable Use
You agree not to:
- Use the app for any illegal or commercial purpose other than personal use.
- Attempt to access other users' accounts.
- Interfere with or disrupt app operation.
- Use automated systems (bots, crawling, scrapers, etc.) to access the app. Access to the app via programming interfaces (API) is permitted only with our prior explicit written approval and in accordance with the relevant API terms of use.
- Harass, bully, or intimidate other users.
- Upload content you have no right to share.
- Create multiple accounts to circumvent blocks or restrictions.
- Upload content and/or submit false or malicious reports.
- Collect or harvest other users' data.
- Use the app to distribute unsolicited messages (spam).
5. Content Moderation
The Company reviews content reported by users and reserves the right, but not the obligation, to remove content or suspend accounts that violate these terms or pose a real risk to the safety, privacy, or rights of other users. You can report content or users by clicking the 3-dot icon on review pages and user profiles. We will make reasonable efforts to address reports within 7 business days, but are not liable for delays or failure to address a report.
- Content may be removed without prior notice if it violates the Terms or poses a safety risk.
- Users whose content is removed or whose accounts are suspended will be notified of the action taken.
- Repeated violations or multiple reports may lead to temporary or permanent suspension of your account.
- If you believe a moderation action was taken in error, you may appeal by emailing: [email protected]. We will review the appeal and respond within a reasonable time.
6. User Blocking
You can block other users by clicking the 3-dot icon on their profile page. When you block a user:
- All content is hidden bidirectionally — you will not see their content, and they will not see yours.
- All "Following" relationships between the parties will be removed.
- You can unblock at any time by clicking the 3-dot icon on the blocked user's profile page. Unblocking does not restore removed follow relationships.
Abusing the block feature to circumvent moderation actions may lead to account suspension.
7. Health and Reviews Disclaimer
Important Health Warning: Reviews, ratings, and nutritional information (including allergen identification, nutritional labels such as kosher/vegan/gluten-free, etc.) appearing in the app are provided by users and third parties, and are intended for general information purposes only. We do not verify the accuracy of nutritional information, and it should not be relied upon for medical or dietary decision-making. If you have food allergies, medical dietary restrictions, or special sensitivities, you must independently verify food ingredients directly with the restaurant/manufacturer before consumption. The Company bears no responsibility for any health damage, allergic reaction, or adverse effect resulting from reliance on information provided through the app. Use of this app is at your sole risk.
8. Push Notifications
The app may send you Push Notifications about account activity (follow requests, likes, replies, messages, etc.), streak reminders, review suggestions, and marketing/promotional content. By registering for the app, you consent to receiving these notifications. You can disable notifications at any time through the app settings or your device settings.
9. In-App Purchases
The app may offer in-app purchases. All purchases are processed through the Apple App Store or Google Play Store and are subject to their terms and refund policies. We do not directly handle payment processing.
10. Advertising
The app may display advertisements from third-party advertising networks. We are not responsible for the content of third-party advertisements. Interaction with advertisements is at your sole discretion.
11. Intellectual Property
All intellectual property rights in the app, including (but not limited to) source code, graphic design, user interface, logo, trade names, trademarks, databases, algorithms, documentation, and non-user content, are the exclusive property of the Company and/or its licensors, and are protected by copyright, trademark, and intellectual property laws in Israel and worldwide. The following are strictly prohibited without our prior explicit written consent:
- Copying, reproducing, distributing, selling, renting, or transferring any part of the app;
- Reverse engineering, decompiling, or attempting to extract source code;
- Creating derivative works or competing applications based on the app;
- Using automated data collection tools (scraping, crawling) from the app or its databases;
- Using the trademarks, logo, or app name without permission.
Users retain ownership of their content as described in section 3, subject to the license granted therein.
12. Privacy
Your privacy matters to us. Please review our Privacy Policy to understand how we collect, use, and protect your information.
13. Termination
We reserve the right to suspend or close your account if you violate these terms. You can stop using the app and delete your account at any time using the "Delete Account" button on the Settings page.
- Accounts may be suspended or closed due to repeated violations of the Terms, multiple content reports, or behavior threatening the safety of other users.
- In cases of serious violations (e.g., threats, illegal activity, harassment), we may suspend the account without prior notice.
- If your account is suspended, you may appeal the decision by email: [email protected].
- Upon permanent account closure, account data will be deleted in accordance with the data retention procedures in our Privacy Policy.
14. Limitation of Liability
The app and services are provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including (but not limited to) warranties of merchantability, fitness for a particular purpose, non-infringement, or continuous availability. We do not guarantee that the app will be error-free, completely secure, or available without interruption. To the maximum extent permitted by law, the Company shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the app. Our total liability for any claim arising from the app shall not exceed the amount you paid us in the 12 months preceding the claim, or USD 100.
15. Indemnification
You agree to indemnify and hold harmless the Company, its directors, employees, agents, and business partners, from any claim, damage, loss, liability, expense, or cost (including reasonable attorney's fees) arising from: (a) your content or its infringement of third-party rights; or (b) your use of the app in violation of these terms or applicable law; or (c) your infringement of intellectual property, privacy, or other rights of a third party.
16. Dispute Resolution
Any dispute arising from these terms or use of the app shall first be resolved through good-faith negotiation. If the dispute cannot be resolved within 30 days, it will be referred to binding arbitration, except that either party may bring appropriate claims in small claims court. You agree to waive any right to participate in a class action or class arbitration against the Company.
17. Governing Law
These terms shall be governed by and construed solely in accordance with the laws of the State of Israel, without regard to its or any other jurisdiction's conflict of law rules. Exclusive jurisdiction over any dispute shall be vested in the competent courts of Israel, and the exclusive venue for conducting proceedings shall be the Tel Aviv district.
18. Severability and Entire Agreement
If any provision of these terms is found to be unenforceable or unlawful, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect. These terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding use of the app, and supersede any prior agreements.
19. Changes to Terms
We reserve the right to modify, update, or replace these terms at any time. We will publish updated terms in the app and update the "Last Updated" date at the top of the document. Material changes (e.g., changes to the payment model, service restrictions, or intellectual property rights) will be brought to your attention via an in-app notification (pop-up) or email to the address registered on your account, at least 14 days before they take effect. Your continued use of the app after publication of the changes or after the notice period expires (whichever is later) constitutes acceptance of the updated terms. If you do not agree to the changes, you must stop using the app and delete your account.
